TERMS AND CONDITIONS
The Terms and Conditions (TC) apply to all contracts, deliveries and other services from vinyl harvest (the seller) to the customer (the buyer). The Sale The sale (contract) between the seller, vinyl harvest (VH) – Claudio Caruso and the buyer will be governed in terms of articles made by the seller or purchased from third parties in TC with the exclusion of all prior oral or written agreements. Luxembourg law applies to the contract excluding UN purchase rights. Our offers are not binding. All given prices are in Euros and include 17% sales tax .
2. Order & Contract
The order and contract between the seller and the buyer on the purchase of goods is due to the carrying out and finishing the purchase by the buyer (binding offer) and by confirmation and acceptance by the seller. The confirmation is generally followed inside one working day by an email to the buyer. The acceptance of the buyer’s order is followed by the shipment of the goods. Vinyl Harvest reserves the right to not accept the order if the articles are not paid. If an order cannot be fulfilled, the buyer will be informed as soon as possible.
The payment of goods for the buyer can be made through the following methods: – PayPal (firstname.lastname@example.org) – Prepayment to bank account: Vinyl Harvest Record Store Banque et Caisse d’Epargne de l’Etat Luxembourg IBAN: LU10 0019 5155 4461 7000 BIC/SWIFT: BCEELULL – Gift voucher code In the event of goods being returned, the invoice amount will be reduced accordingly. Until full payment from the buyer the goods remain the property of the seller. All goods located in the stock of the seller will be, by pre-payment from Paypal or on receipt of bank payment, be sent within 1-3 working days
In case of defective delivery (excludes non insured shipping option) the seller will accept the shipping charges. In case of defective goods (excludes when due to uninsured shipping option) the buyer has the right to receive new goods to the value of the purchase price. Monetary compensation can only be given when a wrong delivery has been made by the seller and the goods cannot be replaced by an equivalent.
5. Disclaimer for online content
The seller assumes no responsibility for the topicality, correctness, completeness or quality of the information provided. Liability claims against the seller, which refer to damages of material or immaterial nature caused by use or disuse of the presented information is due to the use of incorrect or incomplete information, is excluded provided the seller has no demonstrable or gross negligent fault. All offers are not-binding and without obligation. The seller expressly reserves the right to change or modify parts of the website, or the entire offer without prior notice, to delete, add or discontinue the publication temporarily or permanently. The seller guarantees that the goods comply with the descriptions contained in the contract. It can however cause certain deviations in style, colour, size or finish, or some irregularities in the packing. For this, no warranty / liability can be accepted.
6. Disclaimer for external links
When links are included to other sites on the vinyl harvest website the seller declares explicitly to have no influence on the design and contents of linked pages. Therefore the seller expressly distances itself from the contents of all third party linked pages and does not adopt any of the contents. This declaration applies to all links and for all contents of sites to which these links lead.
The purchaser guarantees that all the information given is real, truthful and complete. The seller processes and stores, as part of terms and conditions, the customer received personal data in compliance with the statutory regulations. The purchaser agrees to the recording of the address data in the customer file until request to be revoked. Customer information will not be given to third parties except when it is necessary for fulfillment of contract.
8. Final provisions
Should one or more of these terms and regulations be ineffective, this shall not invalidate the entire contract. The ineffective regulation is replaced by the relevant statutory scheme.
